Introduction

Welcome to FlyingCarAI, a service that turns photos into short AI-generated videos (the "Service"). These Terms of Service (the "Terms") govern your access to and use of FlyingCarAI, including our website at flyingcaraivideo.org (the "Site").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

Not affiliated with Tesla

FlyingCarAI is an independent, fan-made service. It is not affiliated with, endorsed by, or sponsored by Tesla, Inc. Tesla and Roadster are trademarks of Tesla, Inc., and are used on the Site only to describe the public event the effects are inspired by.

Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using FlyingCarAI, you represent and warrant that you meet this requirement.

If you use the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Account Registration

To generate videos, you need an account. You agree to provide accurate and up-to-date information and to keep your account credentials secure.

You are responsible for all activities that occur under your account. If you believe your account has been compromised, you must notify us immediately.

Use of the Service

Permitted Use

FlyingCarAI grants you a limited, non-exclusive, non-transferable, and revocable licence to access and use the Service in accordance with these Terms.

Prohibited Conduct

You agree not to:

• Use the Service for unlawful, harmful, or abusive purposes
• Upload or generate content that infringes intellectual property rights
• Upload a photo of a person other than yourself without their permission, or a photo of a public figure or celebrity
• Present a generated video as real footage, or use it to deceive, defraud, harass, or impersonate anyone, including any real company, vehicle maker, public authority, or police force
• Attempt to reverse engineer or interfere with the Service
• Use automated tools (bots, scrapers) without authorization
• Disrupt or compromise the security or functionality of the Service

When you share a generated video, keep it clear that it is AI-generated fiction.

User Content

Ownership and Responsibility

You retain ownership of the photos you upload and the videos you generate using the Service ("User Content"), except for any FlyingCarAI Materials they incorporate, which are described below.

You are solely responsible for your User Content and for ensuring that it complies with applicable laws and these Terms.

FlyingCarAI Materials

The effects supply material of our own that is incorporated into your User Content, including effect recipes and their prompts ("FlyingCarAI Materials").

FlyingCarAI Materials remain the property of FlyingCarAI or its licensors. We grant you a worldwide, non-exclusive, royalty-free licence, for as long as these Terms remain in force, to use FlyingCarAI Materials solely as they are embodied in your User Content. This licence does not allow you to extract, isolate, or reuse FlyingCarAI Materials separately from the User Content they appear in.

Third-party rights

User Content generated through the Service is produced with third-party AI models. Third-party terms or rights may apply to it, and FlyingCarAI does not grant you any third-party rights.

No warranty as to legal status

AI-generated material may not be eligible for copyright protection in some jurisdictions. FlyingCarAI makes no warranty as to the legal status of User Content.

Licence to FlyingCarAI

To run the Service, you grant FlyingCarAI a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, and make the technical modifications and derivative copies the Service requires — including transcodes and thumbnails — for the purposes of operating and securing the Service, moderating content, and responding to support requests and conducting administrative review.

You grant FlyingCarAI the right to sublicense the rights above only to service providers acting on FlyingCarAI's behalf, and only to the extent needed to provide the Service. This includes the AI model providers that generate your videos and the moderation services that review them.

Your User Content is private to your account. FlyingCarAI does not publish it, and does not train AI models on it. Third-party providers that receive your content in order to generate or moderate it handle it under their own terms.

Intellectual Property

All rights, title, and interest in the Service — including its software, design, text, graphics, logos, and FlyingCarAI Materials — are owned by FlyingCarAI or its licensors. Except as expressly permitted, you may not use FlyingCarAI's intellectual property without prior written consent.

This section does not apply to User Content, which is governed by the User Content section above.

Credits and Payments

Generating videos uses credits, which you buy in one-time credit packs. There are no subscriptions and nothing renews automatically. The credit cost of each video is shown before you generate it, and credits used by a failed generation are returned automatically. Credits have no cash value and cannot be transferred.

Refunds are governed by our Refund Policy, available on a separate page.

Termination

You may stop using the Service at any time. FlyingCarAI may suspend or terminate your access if you violate these Terms or if required to comply with legal obligations.

Upon termination, your right to use the Service will immediately cease.

Disclaimer of Warranties

The Service is provided "as is" and "as available." FlyingCarAI makes no warranties regarding availability, reliability, or accuracy, and disclaims all implied warranties to the fullest extent permitted by law.

Limitation of Liability

To the maximum extent permitted by law, FlyingCarAI shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes by updating the date at the top of this page and, where appropriate, sending a notice through the Service. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
